Welcome to Karmick Institute. These Terms of Service (“Terms”) govern your use of the Karmick Institute website, physical campus, courses, content, and services (collectively, the “Services”).

When you access or use the Services, you accept and agree to be bound by these Terms and our Privacy Policy. To proceed with using the Services, you are required to accept these Terms.

1. Acceptance of Terms

1.1. Agreement: This document is a legally binding agreement between you (“User,” “Student,” or “You”) and Karmick Institute (“The Institute,” “We,” “Us,” or “Our”). By simply using the website or signing up for a course, you confirm that you’ve read and agree to all of these Terms

1.2. Eligibility: To join our courses or use our payment options, please make sure you are 18 or older, or reaching the legal age of majority in your area. If you are a minor, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. Course Enrolment, Fees, and Payment

2.1. Course Availability and Changes: The Institute reserves the right to update, suspend, or discontinue any course, curriculum, schedule, or fee structure at any time without prior notice. In the event of a significant course cancellation by the Institute, enroled students will be offered enrolment in a comparable course or a pro-rata refund of prepaid fees.

2.2. Fee Structure and Payment:

All course fees and any other charges are payable in Indian Rupees (₹) unless otherwise specified.
Fees must be paid according to the payment schedule agreed upon at the time of enrolment (e.g., upfront or via approved instalments/EMI plans).
Failure to make timely payments may result in the temporary suspension or permanent termination of access to course materials, classes, and certification benefits.

2.3. Refund and Cancellation Policy:

General Rule: All fees paid to the Institute (including course fees and instalment payments) are generally non-refundable once the enrolment process is complete and access to course materials has been granted, or the course start date has passed.
Exception: Refunds, if any, will only be considered in extraordinary circumstances, at the sole discretion of the Institute’s management, and will be subject to an administrative deduction.
No Chargebacks: Once you make a payment, you’re agreeing to try and resolve any disputes directly with us first. Please don’t cancel or ‘charge back’ the transaction through your bank without giving us a chance to help.

3. Student Conduct and Academic Integrity

3.1. Code of Conduct: Students are expected to adhere to a professional standard of conduct on the campus and in all online interactions. Prohibited actions include, but are not limited to, disruptive behaviour, harassment, vulgar language, and unauthorised recording of lectures.

3.2. Academic Integrity: Students are strictly prohibited from engaging in any form of academic dishonesty, including:

Plagiarism: Presenting the work, ideas, or language of others as your own.
Cheating: Using unauthorised materials or aids during examinations or assessments.
Impersonation: Taking an examination or completing coursework on behalf of another student, or having another person do so for you.

3.3. Account Security: You are solely responsible for protecting your course login credentials. Please don’t share your course username and password with anyone else. If you do, we’ll have to cancel your enrolment right away, and any refund will be subject to the Refund and Cancellation Policy in section 2.3.

4. Intellectual Property Rights

4.1. Ownership: All content, materials, documents, video recordings, presentations, methodologies, software code examples, website design, trademarks, and logos provided as part of the Services or displayed on the Institute’s website are the exclusive intellectual property of Karmick Institute or its licensed certification partner, Vishlesan I-Hub, IIT Patna, as applicable to the relevant course or programme.

4.2. Limited License: The Institute grants you a limited, non-exclusive, non-transferable right to access and use the course materials solely for your personal, non-commercial educational purposes during your enrolment period.

4.3. Restrictions: Our course materials (like videos, notes, and handouts) are just for you and your personal learning. You must not copy, share, post online, sell, or change any of this content without getting our written permission first. Sharing or distributing our materials without permission is called piracy, and if it happens, we will immediately cancel your enrolment and may also pursue legal action. Essentially: please keep the content to yourself.

5. Placement Assistance Disclaimer

5.1. Assistance, Not Guarantee: Karmick Institute offers Placement Assistance (including resume building, mock interviews, and access to job portals/hiring partners). However, we can’t promise or guarantee that you’ll get a specific job, find employment, or earn a particular salary once you finish the course. We give you the tools and support; your ultimate job success is up to you.

5.2. Conditions: We can only help you find a job if you hold up your end of the deal. That means you need to do well in the course, finish all your assignments and projects, and seriously commit to the job hunt process that our placement team sets up for you.

6. Disclaimers and Limitation of Liability

6.1. No Warranties: The Services are offered without any guarantees regarding their function or availability. The Institute makes no warranties, express or implied, regarding the accuracy, completeness, or reliability of any content, or that the Services will be uninterrupted or error-free.

6.2. Limitation of Liability: To the maximum extent permitted by law, Karmick Institute, its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

Your access to or use of, or inability to access or use, the Services.
Unpermitted access to, or utilisation of, our servers, including any personal data contained therein.
Any disruption or cessation of the Services.

7. Governing Law and Jurisdiction

7.1. Governing Law: The interpretation and application of these Terms are determined by the laws of the Republic of India.

7.2. Jurisdiction: Any legal action or proceeding arising out of or related to these Terms or the Services shall be brought exclusively in the competent courts located in Kolkata, West Bengal, India. You acknowledge and accept that only those courts have exclusive jurisdiction

8. Miscellaneous

8.1. Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Karmick Institute concerning the Services.
